Balti Unlimited, trading as Balti (www.baltistore.nl), respects your privacy and processes your personal data in accordance with the EU General Data Protection Regulation (GDPR) and Dutch implementing law (UAVG). This policy explains what data we collect, why, and what rights you have.

1. Who is responsible for your data

We are the "controller" of your personal data for the purposes of the GDPR.

2. What personal data we collect

Depending on how you use our website, we may collect:

•      Contact and account details: name, email address, phone number, delivery and billing address;

•      Order data: products purchased, order value, order history;

•      Payment data: processed by our payment providers (Mollie, Stripe, Adyen) — we do not store full card details ourselves;

•      Technical data: IP address, browser type, device information, collected via cookies and similar technologies (see our separate Cookie Policy);

•      Communications: messages you send us via email, contact forms, or customer service.

3. Why we process your data, and our legal basis

We rely on the following legal bases under Article 6 GDPR:

•      Performance of a contract — to process and deliver your order, handle payments, returns, and customer service;

•      Legal obligation — to comply with tax, accounting and consumer-protection rules (e.g. retaining invoices);

•      Legitimate interest — to keep our website secure, prevent fraud, and improve our services, balanced against your rights;

•      Consent — for optional marketing emails and non-essential cookies; you can withdraw consent at any time.

4. Who we share your data with

We share personal data only where necessary, with recipients such as:

•      Payment providers, to process your payment;

•      Delivery and logistics partners, to ship your order (PostNL, DHL, DPD and UPS);

•      IT and hosting providers, who process data on our behalf under a data processing agreement;

•      Email/marketing platforms, where you have opted in to marketing communications;

•      Authorities, where required by law.

5. How long we keep your data

2.   Order and invoice data is kept for 7 years, in line with Dutch tax retention obligations.

3.   Account data is kept for as long as you have an active account with us or until you ask us to delete it (subject to Section 4).

4.   Marketing consent data is kept until you unsubscribe or withdraw consent.

6. Your rights

Under the GDPR, you have the right to:

•      Access the personal data we hold about you;

•      Rectify inaccurate or incomplete data;

•      Erasure of your data, where applicable ("right to be forgotten");

•      Restrict or object to certain processing;

•      Data portability, to receive your data in a structured, machine-readable format;

•      Withdraw consent at any time, without affecting processing carried out before withdrawal.

6.   You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl), or with the supervisory authority in your own EU country of residence.

Balti Unlimited, handelend onder de naam Balti (www.baltistore.nl), respecteert je privacy en verwerkt je persoonsgegevens in overeenstemming met de Algemene Verordening Gegevensbescherming (AVG) en de Uitvoeringswet AVG. Deze verklaring legt uit welke gegevens wij verzamelen, waarom, en welke rechten je hebt.

1. Wie verantwoordelijk is voor je gegevens

Wij zijn de "verwerkingsverantwoordelijke" voor je persoonsgegevens in de zin van de AVG.

2. Welke persoonsgegevens wij verzamelen

Afhankelijk van hoe je onze website gebruikt, kunnen wij het volgende verzamelen:

•      Contact- en accountgegevens: naam, e-mailadres, telefoonnummer, afleveradres en factuuradres;

•      Bestelgegevens: gekochte producten, bestelwaarde, bestelgeschiedenis;

•      Betaalgegevens: verwerkt door onze betaalproviders (Mollie, Stripe, Adyen) — wij slaan zelf geen volledige kaartgegevens op;

•      Technische gegevens: IP-adres, browsertype, apparaatinformatie, verzameld via cookies en vergelijkbare technieken (zie ons afzonderlijke cookiebeleid);

•      Communicatie: berichten die je ons stuurt via e-mail, contactformulieren of klantenservice.

3. Waarom wij je gegevens verwerken, en onze grondslag

Wij baseren ons op de volgende grondslagen uit artikel 6 AVG:

•      Uitvoering van een overeenkomst — om je bestelling te verwerken en te leveren, betalingen, retouren en klantenservice af te handelen;

•      Wettelijke verplichting — om te voldoen aan fiscale, boekhoudkundige en consumentenbeschermingsregels (bijv. het bewaren van facturen);

•      Gerechtvaardigd belang — om onze website veilig te houden, fraude te voorkomen en onze dienstverlening te verbeteren, afgewogen tegen jouw rechten;

•      Toestemming — voor optionele marketing-e-mails en niet-noodzakelijke cookies; je kunt toestemming te allen tijde intrekken.

4. Met wie wij je gegevens delen

Wij delen persoonsgegevens alleen indien nodig, met ontvangers zoals:

•      Betaalproviders, om je betaling te verwerken;

•      Verzend- en logistieke partners, om je bestelling te bezorgen (PostNL, DHL, DPD en UPS);

•      IT- en hostingproviders, die namens ons gegevens verwerken op basis van een verwerkersovereenkomst;

•      E-mail-/marketingplatforms, indien je hebt ingestemd met marketingcommunicatie;

•      Overheidsinstanties, indien wettelijk verplicht.

11.         Wij verkopen je persoonsgegevens niet aan derden.

5. Hoe lang wij je gegevens bewaren

12.         Bestel- en factuurgegevens worden bewaard gedurende 7 jaar, conform de Nederlandse fiscale bewaarplicht.

13.         Accountgegevens worden bewaard zolang je een actief account bij ons hebt of totdat je ons vraagt deze te verwijderen (met inachtneming van artikel 4).

14.         Gegevens over marketingtoestemming worden bewaard totdat je je afmeldt of je toestemming intrekt.

6. Jouw rechten

Op grond van de AVG heb je het recht op:

•      Inzage in de persoonsgegevens die wij van je hebben;

•      Rectificatie van onjuiste of onvolledige gegevens;

•      Verwijdering van je gegevens, waar van toepassing ("recht op vergetelheid");

•      Beperking van, of bezwaar tegen, bepaalde verwerkingen;

•      Overdraagbaarheid van gegevens, om je gegevens in een gestructureerd, machineleesbaar formaat te ontvangen;

•      Intrekking van toestemming, op elk moment, zonder gevolgen voor verwerkingen van vóór de intrekking.

15.         Om een van deze rechten uit te oefenen, neem je contact op via basbaltissen@hotmail.com. Wij reageren binnen één maand.

16.         Je hebt ook het recht om een klacht in te dienen bij de Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl), of bij de toezichthouder in je eigen EU-woonland.

7. Cookies

9. Kinderen

19.         Onze website is niet gericht op kinderen jonger dan 16 jaar en wij verzamelen niet bewust persoonsgegevens van kinderen zonder toestemming van een ouder of voogd.

20.         Wij kunnen deze privacyverklaring van tijd tot tijd bijwerken. De versiedatum hieronder toont wanneer deze voor het laatst is herzien; wezenlijke wijzigingen communiceren wij waar wettelijk vereist.
